Federal OSHA announced today that the agency is withdrawing its COVID-19 Vaccine or Testing Emergency Temporary Standard (ETS). 

This withdrawal effectively ends the court case in the 6th Circuit Court of Appeals.  In announcing the withdrawal of the ETS, OSHA’s statement indicated that they may use the ETS as a proposal for a permanent standard in the future. 

The agency did not provide any further details of what it may pursue as a permanent standard, but it would likely be smaller in scope than the ETS which would have covered employers with 100+ employees across most industries.
