On November 16, 2021, Federal OSHA announced that they were suspending activities related to the implementation and enforcement of the Emergency Temporary Standard (ETS) requiring COVID vaccines and testing pending future litigation. This decision was based on the recent temporary stay upheld by the Fifth Circuit Court of Appeals which temporarily blocked OSHA’s ETS. In its ruling, the Fifth Circuit Court said OSHA should “take no steps to implement or enforce the mandate until further court order.”
The multiple lawsuits against OSHA’s ETS will be handled by the U.S. Court of Appeals’ Sixth Circuit in the next few weeks. Xenium will continue to share updates as they become available.
