President Biden recently signed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 into law. This new federal law provides sexual assault and harassment victims the right to file a lawsuit in state, tribal, or federal court, even if they have previously signed an arbitration agreement barring such a lawsuit. Arbitration will still be permitted if the employee who brings forward the claim chooses that option after an incident occurs. Employment arbitration agreements will still be enforceable for claims not related to sexual assault or sexual harassment. The law applies to claims that arise after March 3, 2022, regardless of the date the arbitration agreement was signed.
