An employer must notify employees within three business days of receipt of a notice of an upcoming federal agency inspection of the employer’s records of any documentation used by the employer to verify the identity and employment eligibility of employees hired.
An employer must notify employees of an upcoming inspection by:
- Posting a notice in a conspicuous and accessible location, in English and in the language the employer typically uses to communicate with employees; and
- Making reasonable attempts to distribute individual notifications in the employees’ preferred languages.
The notice must include:
- A copy of the federal agency’s notice of inspection received by the employer;
- The date of the inspection;
- To the extent the employer knows, the scope of the federal agency’s inspection;
- The employer’s obligations with respect to providing information within the scope of the federal agency’s notice of inspection; and
- A telephone number, prescribed by the Bureau of Labor and Industries (BOLI), for a hotline operated by an organization that provides information and advocacy related to immigrant and refugee workers’ rights.
By January 1, 2020, BOLI will create and make available on its website a template notice that employers may use to comply with this law. The template will be available in English and five other languages that are most widely used in Oregon.
